General Terms and Conditions (GTC) - China Foods Alliance / mybow gmbh

1. scope of application shop
These General Terms and Conditions (hereinafter referred to as GTC) apply to all orders and contracts concluded via the online shop www.chinafoods.ch of mybow gmbh, Lucerne (hereinafter referred to as China Foods Alliance or mybow gmbh). 

mybow gmbh reserves the right to amend the GTC at any time. The version valid at the time of the order shall apply. For orders that have already been completed, the version valid at the time the contract is concluded shall apply.

2nd offer
◆ The offer is aimed at natural persons domiciled in Switzerland or legal entities domiciled in Switzerland.
◆ Deliveries are only made to addresses within Switzerland.
◆ The offer is valid as long as it is visible in the online shop and/or stocks last. Prices and product ranges are subject to change at any time.
◆ Product images and descriptions are for illustrative purposes only and are non-binding.

3. prices
All prices are in Swiss francs (CHF) and include value added tax (VAT):
◆ The reduced rate of 2.6 % applies to food, non-alcoholic beverages, books, newspapers and magazines.
For all other products and deliveries, the standard rate of 8.1 % applies.
◆ A minimum order value of CHF 20 applies per order.
◆ The price displayed in the online shop at the time of the order is decisive.

4th order
◆ The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to order.
◆ By sending the order, the customer submits a binding offer to mybow gmbh / China Foods Alliance to conclude a contract.
◆ After receipt of the order, the customer receives an automatic confirmation of receipt, which merely confirms receipt of the order. 
◆ The contract is only concluded when the order is processed in the logistics centre and dispatch is confirmed.
◆ China Foods Alliance / mybow gmbh is entitled to refuse orders in whole or in part without giving reasons. 
◆ Payments already made will be refunded in this case. Further claims are excluded.

5. terms of payment
◆ Payments are made exclusively in Swiss francs (CHF)
Accepted means of payment: credit cards (Visa, MasterCard), TWINT
◆ The debit takes place immediately upon ordering (prepayment)
◆ Purchase on account is not possible

6. delivery
◆ The delivery address must be in Switzerland.
◆ Orders are usually delivered within 1-3 working days after receipt of payment.
◆ No deliveries are made at weekends or on official public holidays (national or cantonal).
◆ Delivery times may be extended in the event of unforeseen circumstances (e.g. force majeure, strikes, transport problems).
◆ Partial deliveries are permitted. Delayed delivery does not entitle the customer to cancel the order or claim compensation.

7. shipping costs
◆ Shipping is free from CHF 80 order value
◆ Below this amount, the shipping costs communicated in the online shop apply

8 Warranty and returns
China Foods Alliance / mybow gmbh can provide the warranty either by replacement delivery or refund.
◆ Returns are possible within 7 days of receipt and must be notified in advance by email to info@chinafoods.ch.
◆ The buyer bears the cost of returning the goods, except in the case of faulty or damaged products.

9. notice of defects
◆ Obvious transport damage or packaging defects must be reported immediately to the deliverer and acceptance refused if necessary.
◆ The customer must document the damage and report it immediately by e-mail to info@chinafoods.ch.
◆ The customer is also obliged to inspect the goods immediately upon receipt and to complain about any defects or deviations on the day of delivery.
◆ The risk is transferred to the buyer as soon as the goods have been handed over to the transport company.
An agreed assumption of the shipping costs has no influence on the transfer of risk.

11. liability
◆ China Foods Alliance / mybow gmbh is only liable for damages caused by wilful or grossly negligent behaviour.
◆ Any liability for consequential or indirect damages is excluded.


12. travel and consulting offers
The China Foods Alliance (a project of mybow gmbh) offers exclusive travel, education and consulting programmes aimed at professionals, SME owners, institutions and gourmets. These trips are not package holidays within the meaning of the Swiss Package Travel Act.

12.1 Role of the China Foods Alliance / mybow gmbh
◆ The China Foods Alliance does not act as a tour operator, but as an advisory and coordination partner (consultant). 
◆ She is responsible for the content planning, conception and organisation of the programmes as well as for supporting the participants on site.

12.2 Implementation by local partners
◆ The travel package within China (accommodation, transfers, domestic flights, entrance fees, tour guides, etc.) is organised and carried out by licensed local partner companies in China.
mybow / China Foods Alliance acts as an intermediary and coordinating body, not as a contractual partner for these travel services.

12.3 Performance of the participants
◆ Participants book their international flights and insurance (e.g. cancellation, health and travel insurance) independently.
◆ The responsibility for visas, entry documents and personal preparation lies with the participants.

12.4 Liability
◆ mybow / China Foods Alliance is not liable for service disruptions, cancellations or changes caused by third parties, force majeure or official requirements. 

13 Terms of payment
◆ With the payment of the reservation fee of 50% the registration becomes binding.

14 Application deadline
CFA books the venues approx. six months in advance to ensure smooth organisation

15 Cancellation Policy
14.1 Cancellation by the participating person:
◆ In the event of cancellation up to 3 months before the start of the trip, the registration fee will be refunded.
◆ No refunds are possible thereafter.

15.2 Substitute participants
◆ The participating person may provide a substitute person who fulfils all travel requirements.
◆ In this case, participation can be partially transferred. 
◆ However, processing fees and additional costs (e.g. for hotels or domestic flights) may apply.

15.4 Alternative agreements
◆ If possible, the trip can be postponed to a later date.
◆ Participants may be given the option to transfer parts of the booking to a later trip.

15.5 Force majeure
◆ If the trip cannot be carried out due to force majeure (e.g. natural disasters, pandemics, political events), refunds or credit notes will be considered in accordance with the agreements with hotels, airlines and partners.
◆ In individual cases, only partial refunds are possible if costs have already been incurred.

15.6 Insurance cover
Participants are expressly advised to check whether their travel insurance covers cancellations due to force majeure.

16. data protection
◆ The privacy policy of China Foods Alliance / mybow gmbh is an integral part of these GTC.
◆ By accepting these GTC, the customer agrees to the privacy policy.

17 Applicable law and place of jurisdiction
◆ Swiss law applies.
◆ The exclusive place of jurisdiction for all disputes arising from or in connection with these GTC is Lucerne, Switzerland.
